Summary Judgment Upheld
on Appeal |
The Mississippi Court of Appeals recently affirmed the summary judgment awarded to the University of Mississippi Medical Center based on the efforts of Ray McNamara and Mike Coleman. Ray and Mike moved for summary judgment at the trial court level arguing that the statute of limitations barred the plaintiff’s claims. The trial court agreed and dismissed the case after converting the motion to dismiss to one for summary judgment. The Plaintiff appealed arguing that the discovery rule applied. Mike argued before the Court of Appeals that the discovery rule did not apply because the case did not involve a latent injury, and the Court of Appeals agreed affirming the trial court.
