At It Again!

Shan Thompson, Rhonda McCullough and Jimmy Boone of Copeland, Cook, Taylor and Bush’s Insurance Defense section successfully represented Bituminous Fire and Marine Insurance Company and Bituminous Casualty Corporation by winning a motion for summary judgment in the lawsuit, Bituminous Fire and Marine vs. Warren E. Hutto et al., No. 4:06CV67TSL-LAA U.S. DistGL. Southern District of MS.

The case involved an insurance coverage dispute relating to claims arising out of alleged intentional criminal conduct and related claims of negligent hiring, supervision, and training. The court held that the defendants claims, “whether characterized as negligence or intentional conduct, are grounded on and arise from intentional conduct . . . just as the policy does not extend coverage to Warren Hutto, it likewise affords his [employer] codefendants no coverage.”
