The firm's business/corporate group assists companies and employers with a wide variety of matters affecting their businesses and personnel. We endeavor to provide our business clients with a full range of services, offering experienced advice and counsel to large and small businesses in a number of industries.
One such area is the Labor and Employment Law Section and Workplace Safety Law Section. Attorneys in these sections have many years of experience in assisting employers of all sizes with personnel issues, providing guidance on the myriad of laws affecting the employment relationship in the workplace. Our attorneys are members of the Labor and Employment Sections of various bar associations, and have spoken to and authored written materials for numerous professional, trade, civic, employer, and bar groups on labor, employment, and safety issues.
We provide counsel and assistance to employers with regard to all aspects of the employment relationship, such as:
- Responding to charges/complaints issued by the EEOC, Wage & Hour, NLRB, OSHA, MSHA, and other regulatory entities.
- Defending employers in state and federal court lawsuits and administrative charges involving Title VII, FMLA, ADA, ADEA, ERISA, FLSA, OSHA, MSHA, WARN, and other federal and state law claims, including issues involving wrongful discharge, unlawful discrimination, retaliation, harassment, whistle-blowing, minimum wage and overtime, leaves of absence, group benefits, disability/reasonable accommodation, military leave, non-competition, breach of contract, independent contractors, reductions in force, employment compensation claims, and workplace safety.
- Drafting/revising employee handbooks, employment policies, employment contracts, severance agreements, contractor agreements, non-competition/non-solicitation/confidentiality agreements, and other employment-related documents for private and public employers, and union and non-union employers, reflecting the individual employer's unique needs and preferences.
- Providing training, including EEO/harassment training and supervisor training, to companies' supervisory personnel and employees.
- Assisting employers with labor issues, such as maintaining non-union status, union elections, negotiation and administration of collective bargaining agreements, grievances and arbitrations, and unfair labor practice proceedings before the NLRB.
- Assisting employers with the development and implementation of affirmative action plans, OFCCP audits, and related matters.
- Providing counsel and assistance to employer-clients on a regular basis with routine employment-related questions and personnel issues, including measures to prevent, reduce, and/or defend potential claims.
